Terms of Service
Last updated 1 January 2026
These terms govern your use of the VistaForge website and the services we provide. By engaging the studio or using this site, you agree to the terms set out below. Please read them carefully.
Agreement
These terms form a binding agreement between you and VistaForge. Where a separate signed proposal or statement of work exists, that document governs the specific engagement and these terms apply to everything it does not address.
Definitions
"Services" means the visual storytelling, chart design, diagram and presentation work we provide. "Deliverables" means the files and materials we produce for you. "You" means the individual or organisation engaging the studio.
Eligibility
You must be at least eighteen years old and able to enter a binding contract. If you engage us on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.
Scope of Services
We provide services as described in the applicable proposal. Work outside the agreed scope requires a change request, which may affect timing and fees. We will tell you before carrying out additional work that changes the price.
Client Responsibilities
You agree to provide accurate data, timely feedback and the rights to any materials you supply. Delays in providing information or approvals may extend timelines. You remain responsible for the accuracy of the underlying figures we visualise.
Fees and Payment
Fees are set out in the proposal. Unless stated otherwise, invoices are payable within thirty days. Late payments may incur interest at the rate permitted by law and may pause ongoing work until the account is current.
Intellectual Property
On full payment, ownership of the final deliverables transfers to you, except for our pre-existing templates, tools and know-how, which remain ours and are licensed to you for use within the deliverables. We may show anonymised work in our portfolio unless you ask us not to.
Acceptable Use
You agree not to misuse this site or our services, including attempting to disrupt them, access them without authorisation, or use deliverables to present data in a knowingly misleading way. We may suspend access for breaches of this clause.
Warranties and Disclaimers
We provide services with reasonable skill and care. Beyond that, the site and services are provided "as is" without further warranties. We do not guarantee any particular business outcome from the presentations we design.
Limitation of Liability
To the extent permitted by law, our total liability for any claim arising from an engagement is limited to the fees paid for that engagement. We are not liable for indirect or consequential losses, including lost profits or lost opportunities.
Termination
Either party may end an engagement with written notice as set out in the proposal. On termination you pay for work completed up to that point, and we hand over any paid-for deliverables in their current state.
Governing Law
These terms are governed by the laws of the State of California. Any dispute will be subject to the exclusive jurisdiction of the courts located in San Francisco, California, unless otherwise required by law.
